Most dredging projects are regulated by some government entity.  Many, however, qualify for an exemption.  In many states, large industrial tailings ponds are exempt if there is no discharge from the immediate tailings pond.  If you need direction in obtaining a permit, the first logical step is the U.S. ARMY Corps Of Engineers.  The Corps Of Engineers will direct you to the proper state authority that administers the Clean Water Act.  The Corps will only get involved if the project involves Wetlands or Section 10 Waters (Navigable).  This restricted Corps authority is the result of a recent court ruling.

Once you are directed to the proper state authority you will encounter various requirements for effluent, turbidity, chemical analysis etc..  Generally coastal states have more stringent standards compared to inland states.  Each state differs in their permit application process.  Some require professional engineering certification.  There can be significant fines for proceeding with a dredging project without prior permit approval.
